The rhythm of patent litigation is changing. Prior to the Federal Circuit's 1995 decision in Markman v. Westview Products, which requires the trial court to construe the claims of the patent in a suit as a matter of law, patent litigation was typically initiated with a bare-bones complaint that conformed to the minimum notice pleading requirements of what is now Form 18 of the Federal Rules of Civil Procedure.
